The basic idea is OK; as you said though I'm not sure of the legal
implications as the penguin is universally associated with the Linux
kernel.
I don't that would be a particular problem, since there are lots
of distributions using penguin variations in their logos.

Hummingbirds don't have much stamina, which is not a connotation I'm
sure we want, but the swallows have definite possibilities. Some of
them
have very nice plumage, too.
I'd be kind of tempted by the Welcome Swallow just because of its
name.
